ADHD, Road Traffic Accidents and Legal Assessment
How does ADHD increase the risk of road traffic accidents?
ADHD is associated with a higher risk of road traffic accidents due to inattentiveness, distractibility, impulsivity, poor judgement, and risk-taking behaviors. Studies show higher rates of careless driving, crashes, slower or inconsistent reaction times, and unsafe driving habits like speeding and going the wrong way of traffic, which contribute to more severe accidents.
Treatment and prevention of accidents
Avoidance of driving may be the simplest way to prevent accidents but driving can be inevitable due to occupational, familial and personal lifestyle requirements. Pharmacological interventions like medication to treat ADHD can reduce the risk by increasing attention and preventing road traffic accidents.
Driving Ability Assessment process for people with disabilities
ADHD is a legally recognized disability in Hong Kong. An adult with ADHD can apply for a Driving Ability Assessment through the Transport Department to receive approval or recommendations for necessary vehicle modifications if they are suitable to drive. If you are certified to suffer from ADHD, our specialist in psychiatry can complete the Supplementary Health Information Sheet and a medical certificate required by the Transport Department. Protected Disability
In Hong Kong, discrimination against individuals with ADHD is prohibited under the Disability Discrimination Ordinance (DDO) (Cap. 487), which protects against unfair treatment on the grounds of disability in areas like employment, education, and the provision of goods and services. ADHD is recognized as a form of mental illness or disability under the DDO, making it unlawful to discriminate against, harass, or vilify someone because of their ADHD. The Equal Opportunities Commission (EOC) is the body responsible for enforcing this law and can help with complaints and investigations.
Reasonable Adjustments at Work
Employers and educational institutions have a legal duty to make reasonable adjustments to accommodate individuals with ADHD.
Anti-Discrimination Laws
It is illegal to discriminate against someone solely because they have ADHD, or to make decisions that negatively impact them in a way that is disproportionately caused by their ADHD, such as firing them from a job.
Legal Recourse
If a person with ADHD faces unlawful discrimination, they have the right to take legal action to claim damages.

Symptoms of inattention and impulsivity are linked to increased risk behaviours (e.g. careless driving, negligence due to poor attention, impulsivity leading to a fight and poor judgment that can lead to trouble with the police and criminal acts.
Legal Proceedings
Individuals with ADHD can face difficulties during legal proceedings, such as trouble with focus, handling a large volume of complex information, and controlling emotions, potentially requiring "special measures" like rest breaks and additional time for memory recall and attention management in the courtroom.

How common is ADHD?
About 11.4% of children aged 3–17 years have ever been diagnosed with ADHD in the US. The prevalence of diagnosed ADHD in adults is around 2.58 percent.
What is the impact of ADHD on a person?
ADHD symptoms cause problems in school and at home for children. Besides having difficulty sitting still to complete homework, they encounter academic difficulties that negatively affect their progress. They are prone to accidents such as falls. In university, they cannot submit their work on time, resulting in a delay in graduation.
Adults cannot complete the work before the deadline and make careless mistakes. Some patients' poor time management and frequent loss of important objects (such as wedding rings, etc.) affect relationships and married life. ADHD patients may be unable to concentrate when driving a car, which results in road traffic accidents. It is possible for adults with ADHD to make some impulsive and dangerous decisions (e.g., impulsively buying a very expensive object or impulsively making a very important life decision, etc.).
What will your doctor/psychiatrist do?
Besides the clinical interview, overseas universities or a local university in the near future provide a new assessment method involving an infrared brain scan, an eye tracker test and a computer test to enhance diagnostic accuracy for adults with ADHD. If ADHD symptoms cause significant impairment in the life or function of children or adults, the person should consult their doctors/psychiatrists. Specific medications can enhance attention and reduce hyperactivity. Hence, medications can improve their quality of life. Medications to treat ADHD are safe and may have mild side effects.
